By accessing the website https://www.1t.plus, services and mobile applications (collectively, the “Platform”), you acknowledge that you have read the following information and accept the terms and conditions set out below and agree to be bound by this document. The term “User” refer to both you personally and any other person on whose behalf you are accessing the Platform. We may change and update this User Agreement from time to time and Users are encouraged to frequently check this page for any changes. You acknowledge and agree that it is your responsibility to review this User Agreement periodically. By visiting or using the Platform, you are deemed to have agreed to the terms set out in this User Agreement, along with other documents and agreements as then posted on the Platform.

1. Other Languages

Users acknowledge and agree that the official text of 1TPlus website is the English version of the website. The website has been translated for the convenience of users using translation software powered by Google Translate. Reasonable efforts have been made to provide an accurate translation, however, no automated translation is perfect nor is it intended to replace human translators. Users also understand that translations are provided as a service to users of the 1TPlus website, and are provided “as is.” No warranty of any kind, either expressed or implied, is made as to the accuracy, reliability, or correctness of any translations made from English into any other language. Some content such as images, videos, etc. may not be accurately translated due to the limitations of the translation software.

Any discrepancies or differences created in the translation are not binding and have no legal effect for compliance or enforcement purposes. If any questions arise related to the accuracy of the information contained in the translated website, refer to the English version of the website which is the official version.

2. No Offer

Any statement of risks of any trade or investment referenced on the Platform should not be regarded as a full disclosure of all risks.

By accessing the Platform, you acknowledge and agree that 1TPlus is not responsible for your use of any information that you obtain from the Platform, that your trading or investment decisions are made on your own for which you bear sole responsibility, and that you use the Platform and the trading bots at your sole risk. Also, 1TPlus shall not be liable for any liability caused by your usage of any information that you obtain from the Platform.

4. Risk of trading and investments in digital assets

You should not transact in a digital asset if you are not familiar with that digital asset. Transacting in digital assets may not be suitable for you. Once you transact on the Platform, your behaviour shall be deemed willingly by yourself, and you shall be deemed to be fully familiar with the digital assets and fiat currency (if involved in the transaction).

You should be aware that the value of digital assets may fluctuate greatly. You should buy digital assets only if you are willing and prepared to accept the risk of losing all of the money you put into such assets. Investment in any of the digital assets available on the Platform carries substantial risk, including the possible loss of principal and performance and returns of any digital asset may vary significantly over time.

1TPlus does not guarantee the performance of any trade or investment, the return of any customer’s principal or the achievement of any rate of return. You should only trade or invest in a digital asset after you have thoroughly reviewed the relevant information of the digital asset. You may wish to consult an independent financial adviser for personal and specific trading and investment advice before entering into any trade.

We use various blockchains and/or blockchain technology to process your digital asset transactions, for example, the Ethereum blockchain. All blockchains and/or blockchain technology may experience unintended events or consequences, including but not limited to backlogs, higher than normal transaction fees, changes to the network, failure, or forks in the protocol. 1TPlus does not own or control any blockchain or blockchain technology, is not responsible for the operation of the blockchain network, and makes no guarantee regarding the blockchain network’s security, functionality, or availability. You may suffer loss as a result of any such events or consequences, and 1TPlus will not compensate you for such loss.

5. Registration

In order to access the Services, Users must first register for an Account. To start placing trade orders, you need to download and install Application and enter your API keys (to the Exchanges you use) to the Application.

Any natural person with full active legal capacity or any legal person may apply for an Account. You must provide your real name and full personal and/or company registration information. All information you provide upon registration must be accurate, complete and up-to-date. In order to verify your Account, we may request additional verification information, such as a copy / scan of your passport, ID card, driver s license, utilities bills, payment method details. 1TPlus reserves the right to accept or reject your Account registration request without additional explanation.

You are entirely responsible for maintaining the confidentiality of the information you hold for your Account, including your password, and for any and all activity that occurs under your Account as a result of you failing to keep this information secure and confidential. You have to notify us immediately, in case of any unauthorized use of your Account.

In case we find at our sole discretion that there is a threat that you are engaging in any suspicious activity, you have provided inaccurate or incomplete information during the registration process or thereafter, you have violated the Agreement or it is necessary for security reasons, we may temporarily suspend your Account until the cause for suspending your Account has been resolved. For security reasons we may in addition block your access to the Platform. You agree that we will not be liable to you or to any third party for termination of your access to your Account and/or the Website as a result of any violation of the Agreement by you.

The Platform allows users that have registered to open an account with 1TPlus to trade digital assets with 1TPlus. Users can utilize various proprietary automated trading systems offered by 1TPlus in executing their trades by completing the trading parameters in respect of the chosen trading bot. The operation of any trading bot is dictated by the parameters set by the users. No trading bot has the ability to exercise any discretion with regard to any trade position without the input of the users. A user may stop the operation of any trading bot at any time.

6. Use of website, services, applications and data

All site, product and services content as text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, artwork and computer code, including but not limited to the design, structure, selection, coordination, expression and arrangement of such content, contained on the Website is owned by 1TPlus. No part and no content may be copied, reproduced, republished, posted, publicly displayed, encoded, translated, transmitted or distributed in any way for publication or distribution without our express written consent.

You may use information about our Platform purposely made available by us for downloading from the Website, provided that you use such information only for your personal, non-commercial informational purpose.

You may not attempt to gain unauthorized access to any portion or feature of the Website, or to any our server, or to any of the Services offered on or through the Website, by hacking, password brute- forcing or any other illegitimate means.

7. Availability of the Platform

The Platform is available on computers and/or mobile devices running the 1TPlus App. 1TPlus will use best efforts to make the Platform available at all times. However, you understand and acknowledge that the Platform is provided over the internet and mobile networks and thus the quality and availability of the Platform may be affected by factors outside 1TPlus’s reasonable control.

1TPlus does not accept any responsibility for unavailability of the Platform, any difficulty or inability to download or access contents on the Platform, or any other system failure that may result in the Platform being not fully available or functioning.

1TPlus is not responsible for providing any technical support or maintenance to you regarding the Platform. 1TPlus may, at its own discretion, update, modify, or adapt the Platform and its functionalities from time to time to enhance customer experience. 1TPlus is not responsible for any downtime resulting from these actions.

1TPlus trading assistance/bot is powered by other Exchange systems, if either API is broken, there might be a risk of losing your positions. Users are solely responsible to ensure the functions of the API where 1TPlus trading assistance/bot will not be responsible for any losses in the event of such occurrences of API loss or malfunction.

8. Liability & indemnity

You are fully responsible for the due performance of your obligations under the User Agreement and must compensate to us any and all damages caused by the non-performance or unsatisfactory performance of your obligations.

To the fullest extent permitted by applicable law, you agree to indemnify, hold and defend us, our officers, directors, shareholders, predecessors, successors in interest, employees, agents, clients and partners, harmless from any demands, loss, liability, claims or expenses, made against us by any and all third-party claims and liabilities arising out of or related to or in connection with your use of the Platform, including any served content that is not provided by us, or your breach of any term of the Agreement. You shall notify us immediately of any matter which could result in any loss, claim, damage, expense or liability subject to indemnification under this section. Such notification will not release you from your indemnification duty. We reserve the right to exercise sole control over the defense, at your expense, of any claim subject to indemnification under this section.

9. Disclaimer of warranty

We do not promise that our Platform or any content or feature will be error-free or uninterrupted, or that any defects will be corrected, or that your use of the Platform will provide specific results. The Platform and services are delivered on an as is and as available basis. All information provided on the Platform is subject to change without notice. We disclaim all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability, fitness for a particular purpose, quality or performance. We make no warranty that the Platform will meet your specific objectives or needs. We make no warranty that the Platform will be free from errors or bugs. We make no warranty that there will be uninterrupted operation of the Platform.

We disclaim any and all liability for the acts, omissions and any conduct of any third parties in connection with or related to your use of the Platform. You acknowledge that we are not a financial institution and do not give or provide you any advice on your trading activity and disclaim any liability for execution of your trading orders. Your sole remedy against us for dissatisfaction with the Platform is to stop using the Platform and/or Services.

The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.

10. Force majeure

You and us shall not be liable for delays or failure to perform under the User Agreement which result directly or indirectly from any cause or condition beyond its reasonable control, including but not limited to, any delay or failure due to any act of God, act of civil or military authorities, act of terrorists, civil disturbance, war, strike or other labour dispute, fire, interruption in telecommunications or Internet services or network provider services, failure of equipment and/or software, other catastrophe or any other occurrence which is beyond its reasonable control and shall not affect the validity and enforceability of any remaining provisions (force majeure).

11. Notices

You agree that we may communicate with you electronically any finance information related to your Account. We may also provide notices to you by posting them in your Account on the Website, or by sending them to an email address that you have previously provided to us. Platform and email notices shall be considered received by you within 24 hours of the time posted or sent.

12. Modifications

1TPlus reserves the right, at our sole discretion, to change, modify, add or remove portions of any part of the terms in this User Agreement, at any time. Your continued use of our Platform means that you accept and agree to the changes.
